Waste Collection Watford Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Watford provides waste collection and related services to domestic and commercial customers. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting or receiving the services from Waste Collection Watford.
Services means any waste collection, removal, clearance, recycling or disposal service provided by Waste Collection Watford.
Waste means any items, materials or substances presented by the Customer for collection, removal, recycling or disposal.
Contract means the agreement between the Customer and Waste Collection Watford for the provision of services in accordance with these Terms and Conditions.
Site means the address where the services are to be carried out.
2. Scope of Services
Waste Collection Watford provides waste collection and related services for domestic households, landlords, letting agents, commercial premises and other customers within our service area. The precise scope of the services to be provided will be agreed at the time of booking and confirmed in our booking confirmation.
Unless otherwise agreed in writing, our services generally include collection and transportation of waste from the Site to an appropriately licensed facility for recycling, recovery or disposal. We do not guarantee recycling of all materials but will use reasonable care to divert waste from landfill where practicable and in accordance with applicable UK waste regulations.
3. Booking Process
3.1 Booking request
Customers may request services by telephone, email or through our online contact channels where available. You will be asked to provide details including your name, contact information, collection address, description and estimated volume or weight of waste, access information and preferred dates.
3.2 Quotes and estimates
Based on the information you provide, we may offer either a fixed-price quote or an estimate. A fixed-price quote is a price we agree to honour provided that the information you supplied is accurate and the waste presented matches the description and volume given. An estimate is an indicative price range based on limited information and may be adjusted on site once we have inspected the waste.
3.3 Booking confirmation
The Contract between you and Waste Collection Watford is formed when we confirm your booking and you accept the quoted or estimated price, whether orally, by email or in writing. We may issue a booking reference or confirmation message as evidence of the Contract.
3.4 Amendments to bookings
If you wish to change the date, time, location or scope of the services after booking, you must contact us as soon as possible. We will use reasonable efforts to accommodate changes but cannot guarantee availability. We may amend the price to reflect any changes in the services required and will notify you of any revised charges before proceeding.
4. Access and Customer Responsibilities
4.1 Access to the site
The Customer must ensure that Waste Collection Watford staff and vehicles have safe, clear and reasonable access to the Site at the agreed time. This includes ensuring that any necessary parking, loading permissions or entry arrangements are in place.
4.2 Preparation of waste
The Customer is responsible for ensuring that waste is made available for collection in accordance with our instructions. Waste should be clearly segregated where requested and must not contain prohibited items or hazardous materials unless this has been expressly agreed as part of the service.
4.3 Parking charges and access fees
Any parking charges, entry fees, congestion charges or similar costs reasonably incurred by Waste Collection Watford whilst performing the services may be added to the Customer’s invoice, unless otherwise agreed in advance.
4.4 Health and safety
The Customer must take all reasonable steps to ensure the health and safety of our staff while on the Site. We may refuse to carry out all or part of the services if we consider that conditions at the Site present a risk of injury, damage or other hazard.
5. Waste Types and Regulations
5.1 Compliance with law
Waste Collection Watford operates in accordance with applicable UK waste management legislation and guidance. We will only carry and dispose of waste using appropriately licensed and regulated facilities and carriers as required by law.
5.2 Prohibited and restricted waste
Certain types of waste are hazardous, regulated or otherwise unsuitable for standard collection. This may include, without limitation, asbestos, clinical waste, chemicals, solvents, gas cylinders, liquids, oils, paint, tyres, contaminated soil, electrical items containing hazardous substances, or other specialised materials. The Customer must inform us in advance if any such waste is to be collected.
We reserve the right to refuse collection of any waste that we reasonably believe to be hazardous, unlawful, improperly described, or unsuitable for the service booked. If we discover such waste at the time of collection, additional charges may apply for safe handling, or we may decline to remove it.
5.3 Duty of care
The Customer remains responsible for the waste until it is collected by Waste Collection Watford. By presenting waste to us, the Customer warrants that they have the right to dispose of it and that it has been stored, handled and described in accordance with applicable duty-of-care requirements. We may require the Customer to provide information or documentation regarding the source and nature of the waste.
5.4 Environmental objectives
While we aim to maximise reuse and recycling wherever commercially and technically feasible, we cannot guarantee any particular recycling rate. Our priority is to manage waste in a lawful, safe and responsible manner consistent with current UK environmental regulations.
6. Pricing and Payment
6.1 Prices
Our charges are based on factors such as waste volume or weight, the type of materials, labour required, access conditions, distance, and any additional services requested. All prices quoted are exclusive of any applicable VAT, which will be added at the prevailing rate where required by law.
6.2 Payment terms
Unless otherwise agreed in writing, payment is due on completion of the services. We may require payment in advance or a deposit for certain bookings, particularly larger collections or commercial work. Accepted payment methods will be communicated at the time of booking and may include cash, card or bank transfer.
6.3 Overdue payments
If the Customer fails to pay any amount due under the Contract by the due date, we may charge interest on the overdue sum at the statutory rate and recover from the Customer any reasonable costs incurred in seeking to recover the debt. We may also suspend further services until outstanding amounts are paid.
6.4 Price adjustments on site
If, upon arrival at the Site, the actual volume, weight, type or condition of the waste differs materially from the description provided at booking, we may revise the price accordingly. We will explain the reasons for any change and obtain the Customer’s agreement before proceeding. If the Customer does not accept the revised price, we may cancel the service and a call-out or cancellation charge may be applied.
7. Cancellations and Rescheduling
7.1 Customer cancellations
The Customer may cancel or reschedule a booking by giving us notice by telephone or email. Where possible, we ask for at least 24 hours’ notice before the scheduled collection time. If adequate notice is given, any deposit paid may be refunded or applied to a new booking, subject to our discretion.
If the Customer cancels or reschedules with less than 24 hours’ notice, or if we are unable to complete the service due to the Customer’s failure to provide access or accurate information, we may charge a reasonable cancellation or call-out fee to cover our costs.
7.2 Company cancellations
We reserve the right to cancel or postpone the services at any time due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, staff illness, road closures or safety concerns. In such cases, we will endeavour to offer an alternative appointment as soon as reasonably practicable. Our liability for cancellation in these circumstances will be limited to the refund of any sums paid for services not provided.
8. Customer Property and Site Condition
8.1 Removal of items
The Customer must ensure that any items or materials they do not wish to be removed are clearly identified and kept separate from waste intended for collection. Waste Collection Watford will not be liable for the removal of items that the Customer failed to distinguish from waste, provided that our staff acted reasonably and in good faith based on the information and instructions given.
8.2 Damage to property
We will take reasonable care when carrying out the services. However, the Customer accepts that some risk of minor damage may arise when moving bulky items or accessing tight spaces, particularly where the Customer has requested removal from within a building, loft, basement, garden or restricted area.
The Customer must inform us of any fragile surfaces, fixtures or property that may be at risk. We will not be liable for damage caused by pre-existing defects, wear and tear, faulty construction or inherent risks associated with the requested method of access.
9. Liability and Limitations
9.1 General liability
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
9.2 Exclusions
Subject to the above, Waste Collection Watford will not be liable for any loss of profits, loss of business, loss of goodwill, loss of data or any indirect or consequential loss arising out of or in connection with the services or these Terms and Conditions.
9.3 Financial cap
Subject to the limitation above, our total liability to the Customer in respect of all losses arising under or in connection with the Contract, whether in contract, tort, breach of statutory duty or otherwise, shall not exceed the total price paid or payable for the services that gave rise to the claim.
9.4 Indemnity
The Customer shall indemnify Waste Collection Watford against all claims, costs, damages and expenses arising from any breach by the Customer of these Terms and Conditions, including any misdescription of waste, unlawful or hazardous waste presented without prior notice, or failure to comply with legal obligations relating to waste.
10. Complaints and Service Issues
10.1 Reporting issues
If you are dissatisfied with any aspect of our services, you should notify us as soon as possible, providing details of the issue and any supporting information. We will investigate the matter and aim to resolve complaints promptly and fairly.
10.2 Remedies
Where we agree that services have not been provided with reasonable care and skill, we may, at our discretion, offer to re-perform the services, make a price adjustment or provide another appropriate remedy in accordance with your statutory rights.
11. Data Protection and Privacy
We collect and process personal data as necessary to provide our services, manage bookings, process payments and communicate with customers. We will handle personal information in accordance with applicable UK data protection legislation and will only use your details for legitimate business purposes associated with the provision of services, administration and legal compliance.
12. Force Majeure
Waste Collection Watford shall not be liable for any delay in performing, or failure to perform, any of its obligations under the Contract if such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include extreme weather, strikes, accidents, acts of government, public emergencies or interruptions to transport or utilities. In such circumstances, we may suspend the services for the duration of the event or terminate the Contract if performance becomes impossible.
13. Variations to Terms
We may amend these Terms and Conditions from time to time to reflect changes in law, best practice or the way we operate. The version in force at the time of your booking will apply to that Contract. Any substantial changes will be made available on request.
14. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Waste Collection Watford.
15. General Provisions
15.1 Entire agreement
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and Waste Collection Watford in relation to the services and supersede any previous agreement, understanding or arrangement.
15.2 Severance
If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall remain in full force and effect.
15.3 Waiver
No failure or delay by Waste Collection Watford to exercise any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy.
15.4 Assignment
The Customer may not assign, transfer or subcontract any of their rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary for the proper provision of the services.
